Cannabis Retail Business Registration
Cannabis Ordinance
Minnesota passed a new law in 2023 legalizing adult-use cannabis (21 and older) and established a regulatory framework for the cannabis industry. The law contained within it the creation of the Office of Cannabis Management (OCM) to oversee applications, issue of licenses and establishment of cannabis rules.
Low-Potency Hemp Retailers
Included in this new law Minnesota State Statute 342.22 requires that all cannabis businesses including low-potency hemp retail locations with products containing THC, CBD or both to first register with the State and then submit an application for licenses (lower-potency hemp edible (LPHE) licenses) in the fall of 2025. At that time, the hemp registration system will end and all registered businesses who wish to continue selling LPHEs will be required to apply for, and obtain, a license under Minnesota Statutes, chapter 342.
- Under Minnesota Statutes, section 342.18, subdivision 4, a hemp business must have been registered prior to the adoption of rules (April 14, 2025) AND be in good standing with the state to qualify for conversion to licensure.
- Existing hemp registrants will remain governed by Minnesota Statutes, chapter 151.72 until they are officially licensed by OCM.
- Businesses who are not registered but are interested in selling LPHE-R products will be eligible to apply for a license in the fall as well but will not be able to sell LPHE products until the license has been issued.

The Lakeville City Council adopted new City ordinances on Regulation of Adult Use Cannabis Business Operations on September 16, 2024 (see ordinances below).
Adult-Use Cannabis
All applicants for adult-use cannabis should first start by contacting the OCM to begin the application process. The Lakeville City Council approved a maximum of six (6) Cannabis Retail Business Operations. Applications will be processed on a first-come, first-served basis upon the City receiving a completed application. A copy of your valid license or license pre-approval issued by the OCM is required. A retail store shall not operate within 500 feet of a school.

Questions related to Zoning or Registration can be directed to either the Lakeville Community Development Department, or the Lakeville City Clerk.

Minnesota Resources
